בלהט המחלוקות על משוב השופטים של לשכת עורכי הדין הצעתי למדגם מסויים של עורכי-דין “משובון” קטן.
כעת, אחרי שיש לי תמונה ברורה-למדי על עמדתם של עורכי-הדין, אני מרחיב את קהל-היעד של המשוב, ופותח אותו לקהל הרחב.
המשוב הזה מתייחס לגזרה מאוד מצומצמת של אמון הציבור בשופטיו – אמונו של המפסיד במשפט.
לא צריך להיות “מבין” גדול כדי לדעת שהצד הזוכה במשפט ירחש אמון רב לבית המשפט (עד שגם הוא יפסיד …).
ומה עם הצד המפסיד?
כאן בדיוק נבחן אמון הציבור בשופטיו: האם יאמר המפסיד לעצמו אמנם השופט טעה, לטעמי, אבל נחה דעתי שהוא פעל ביושר, בתום-לב ובחריצות, התייחס בכבוד לכל טענותי ולא התעלם מהטענות והראיות שלא היה לו נוח להתמודד איתן?
השאלה העומדת למבחן במשוב הזה היא, איפוא, אמון הציבור בבית המשפט – בעיני הצד המפסיד.
אתם מוזמנים, איפוא, להתייחס לתיק האחרון בו הפסדתם את ה”קייס”, או לתיק החשוב ביותר (בעיניכם) בו הפסדתם את הקייס, או להתרשמותכם הכללית מהתיקים בהם הפסדתם את הקייס – הכל לפי החשיבות שכל אחד מכם מייחס לכך.
הערה קטנה: בשאלות המשוב לא נתתי אפשרויות-ביניים בין שופטים שלא מתייחסים לאף אחת מהטענות לבין אלה שמתייחסים לכולן. שופט שמתייחס ל-99 מטענותיך ופוסק לרעתך תוך שהוא מתעלם מטענת-המחץ ה-100 שלך – מבחינתי זה כאילו שהוא לא התייחס לאף אחת מטענותיך.
