לאחרונה נדרש בג”ץ ע”י העותרים ח”כ ביילין ואחרים, לסוגיה הבעייתית מדוע הממשלה איננה מכריזה על מצב מלחמה עפ”י סעיף 40 לחוק יסוד: הממשלה, העוסק בהכרזת מלחמה ובצעדים המתחייבים מהכרזה כזו.
מטרת העותרים היתה לנסות לסייע לחקיקה הנוגעת לאזרחים בעורף, אשר נפגעו כתוצאה מהתקפות החיזבאללה, ולשם כך ביקשו לבקר את התקינות החוקתית של תהליכי קבלת החלטת הממשלה בקשר לתחילת הפעילות הצבאית בלבנון, וביקשו סעד מרחיק לכת שבג”ץ יחייב את הממשלה להכריז על מצב מלחמה.
בג”ץ, בראשות הנשיאה המיועדת, גב’ בייניש, והשופטות פרוקצ’ה וארבל, דחה את העתירה בהסבירו כי הממשלה פעלה בערוץ המוקנה לה בסעיף 40(ב) המאפשר לה לבצע פעולות צבאיות הנדרשות למטרת הגנה על המדינה ובטחון הציבור גם ללא הפרוצדורה של הכרזת מלחמה המופיע בסעיף 40(א) ובכך עקף את תפוח האדמה הלוהט שהונח לפתחו.
בג”ץ אמנם הבהיר כי פתיחת מלחמה היא שאלה סבוכה ולה היבטים רבים, הכרוכה בסמכויות הממשלה ביחס לפעילות צבאית ו”שזורה ביחסי החוץ של המדינה ובתפקודה של הממשלה במישור היחסים הבינלאומיים… להחלטת ממשלה שעלולה להתפרש כהכרזת מלחמה עשויות להיות תוצאות מרחיקות לכת במישור היחסים הבינלאומיים”, ברם, בפסה”ד המלומד של השופטות הנכבדות, אין ואף לא אזכור לעובדה שהנושא כלל אינו שפיט.
מדיניות החוץ והביטחון של המדינה מסורה בידי הממשלה. זוהי שאלה פוליטית שאיננה שפיטה ומסורה כל כולה לרשות המבצעת, ובג”ץ לא מוסמך להתערב בה.
האם ביהמ”ש יכול להכריח את הממשלה להכריז על מלחמה? באיזה שיטה משפטית בעולם ניתן בכלל לפנות לבימ”ש כלשהו ולבקש סעד מסוג זה?
נראה, כי רק בשיטה המשפטית שלנו, הלוקה באקטיביזם שיפוטי חסר אח ורע בעולם, ניתן להעלות על הדעת כי ביהמ”ש יחייב את הממשלה לפתוח במלחמה…
על אף שהעתירה נדחתה, פסה”ד מהווה עלית דרגה נוספת באקטיביזם השיפוטי הרדיקאלי וההרסני של ביהמ”ש העליון.
דבר לא היה נגרע מכבודו של בג”ץ אילו היה קובע את הקביעה הטריוויאלית והברורה – ביהמ”ש איננו מכריז לא על מלחמה ולא על שלום וכל הנושא איננו שפיט.
מבחני השפיטות בוטלו כמעט לחלוטין בפסיקת בג”ץ בראשות הנשיא ברק, ודומה כי פס”ד זה מהווה תמרור אזהרה לגבי הצפוי לנו בהמשך לאחר פרישתו של הנשיא בחודש ספטמבר וממחיש באופן נדיר עד היכן הגיע האבסורד בגישתו האקטיביסטית של בג”ץ.
דומה כי החריש העמוק שחרש הנשיא ברק בפסה”ד שלו במשך כהונתו הארוכה בעליון, וכתיבתו האינטנסיבית והיצירתית, עומד ללוות אותנו עוד שנים ארוכות ולהמשיך בביטול עקרון הפרדת הרשויות שמבחני השפיטות נועדו, בין השאר, להגן עליו.
הרכבו של ביהמ”ש העליון עומד להשתנות בחודשים הקרובים עקב הצורך במינויים של חמישה שופטים, שליש ממניינו של העליון.
לאור העובדה המצערת שאפילו בעניינים של מלחמה ושלום מתקבלת החלטה פה אחד בה אין זכר לנושא השפיטות הזועק השמיימה, ראוי כי שר המשפטים יבחן את התאמתם של המועמדים השונים לכהונה בעליון, עפ”י עמדתם בנושא האקטיביזם השיפוטי.
המשך ההליכה בכיוון הרדיקאלי והאקטיביסטי שאפיינו את העליון בשנים האחרונות, המביא אותו לקבל החלטות פוליטיות ואידאולוגיות פעם אחר פעם, על אף שבקרב הציבור בכלל ואפילו בקרב ציבור המשפטנים, קיימים קולות רבים המתנגדים לקו זה, יביאו רק להמשך הפגיעה במעמדו של העליון ולאובדן אמון הציבור בו.
