מדוע לא אצטרף לפסטיבל הנאור הזה?
נשיאת ביהמ“ש העליון לשעבר, מרים–כלענה (הידועה גם בשם מרים נאור) גמרה שעות ביום 24.1.2022, והמהומה רבה.
אני אתייחס כאן לביקורת שהטיח בה חה“כ בצלאל סמוטריץ’, בו ביום:
ח“כ בצלאל סמוטריץ׳ (הציונות הדתית) לא ממהר להספיד את נשיאת בית המשפט העליון בדימוס, השופטת מרים נאור, שהלכה לעולמה בגיל 73, ומזכיר כמה מההחלטות שקיבלה בעת שהיתה נשיאת העליון.
בראיון לרדיו גלי ישראל אמר סמוטריץ‘: “אשתף אתכם בדילמה של הצוות שלי. מצד אחד כביכול מן הראוי להיות ממלכתי ולספוד לה, מצד שני מה לעשות, אני לפחות – אזכור את מרים נאור כמי שהתעקשה להרוס את הבתים בעופרה ובעמונה ובנתיב האבות.
“אזכור אותה כמי שביטלה את השתתפותו של שופט עליון כנציג סגל א‘ בטקס ממלכתי שהממשלה החליטה על קיומו לציון 50 שנה לשחרור חבלי המולדת ביו“ש. כמי שפסלה את חוק הגיוס והכניסה אותנו לטרללת שנמשכת עד היום”.
סמוטריץ‘ טען כי מרים נאור היא “עוד נשיאה אחת בשרשרת נשיאים מאז אהרון ברק שהחריבו מוסד מפואר. לפחות בשנותיה האחרונות היא תיזכר כמי שהפילה עוד לבנה אחת בחומה החשובה של מערכת המשפט. קשה לי להיות צבוע, ראיתי את שקד כותבת עליה ‘חברה אהובה‘, קשה לי להיות צבוע“.

וכמובן כל השמאלצים לזכותה – מכל מי שלא ראה את מגפיה המסומרים במבט מלמטה.
סמוטריץ’ הגזען אינו כוס התה שלי, אבל אני בא לתמוך כאן בזכותו של סמוטריץ’ לומר מה שהוא רוצה, ומתי שהוא רוצה.
כל מוקירי זכרי יודעים על מה אני תוקף את השופטים, ועל מה לא: אני מבקר את תרבות השפיטה הקלוקלת שלהם – לא את התוצאה שהם מספקים.
אם הם יפעלו בחריצות, במקצועיות, ביושר וביושר אינטלקטואלי – לא תשמעו ממני אפילו מילה אחת בגנותם, אפילו אם התוצאה לא תהייה לטעמי, אבל אם הם לא יפעלו בחריצות, במקצועיות, ביושר וביושר אינטלקטואלי – אני אכניס להם באבי–אביהם, אפילו אם התוצאה תהייה גם תהייה לטעמי.
ואם הפרשנות שלהם לחוק לא תהייה לטעמי – אני אעביר את הדחפורים שלי מבית המשפט אל בית המחוקקים (לא רחוק, כמה מאות מטרים, אפשר לנסוע על השרשראות).
סמוטריץ’, מצידו, דווקא משתין בקשת גבוהה על תרבות השפיטה – הוא רק רוצה מהם תוצאה שתתאים לאג’נדה הפוליטית שלו, ואמירתו כי מרים נאור היא “עוד נשיאה אחת בשרשרת נשיאים מאז אהרון ברק שהחריבו מוסד מפואר” – היא הנותנת, משום שמערכת המשפט וביהמ”ש העליון מעולם לא היו מוסד מפואר: אני מכיר אותו כמעט 60 שנה, וכבר בהיכרותי הראשונה איתו הוא היה מוסד רקוב, מסואב, נקמן וחסר יושר ויושר אינטלקטואלי.
זהו ההבדל בינו לביני, אבל בכל זאת אני אתמוך בזכותו לומר את הדברים הרעים ביותר – בזמן הנראה לו – אפילו אם גופתה של המנוחה “עוד לא התקררה“.
כן, אני מכיר את “אחרי מות, קדושים אמור“, אבל, כמו שאני מרבה לומר, מי שמשתין על כללי המשחק בחייו – שלא ייאחז בהם במותו, מי שמנצל לרעה את כוחו, משכיב את החלשים אל הקרשים וממשיך לבעוט בהם גם אז, שלא יבוא בטענות על מי שעושה לו את אותו הדבר כאשר הוא כבר מתחת לקרשים, ומי שלא מכין את הגנתו עוד בחייו – אין לו להלין אלא על עצמו (ביטוי ששופטינו אוהבים להשתמש כנגד אחרים – לעולם לא כנגד עצמם).
ראו, למשל:
נשיא החיים הקלים, נשיא הצביעות, נשיא הפינג–פונג; נשיא האיפה–ואיפה והמוסר ההוטנטוטי; נשיא הקמצנות, נשיא השרירות; נשיא החזירות; נשיא הגנבים *** מאיר שמגר ענק? אולי בדורותיו!
קווים לדמותו של מי שאמר על עצמו “איני יושב בבית המשפט העליון כדי לדון בכל עוולות המדינה”, ותשובה לתשפוכת הסופרלטיבים הנקשרים לצבוע שעזב אותנו ערב יום כיפור, בלי לבקש סליחה מאיש.
זה אשר האזין “בסבלנות אין קץ” לסניגורו של אייכמן, רוברט סרוואציוס, כאשר לא הייתה לו כל ברירה אחרת, משום שכל העולם עקב אחרי ניהולו את המשפט, אבל “סבלנות אין קץ” לשמוע בעלי דין “רגילים” – לא ממש הייתה לו.
אידיוט, שקרן, לא ישר ולא הגון, לא מקבל את העיקרון שעל עברות שבין אדם לחברו אין יום הכיפורים מכפר, לא יהודי.
אצלו למדתי מה שעושים כאשר הדיון בעיכוב–הביצוע נדחה עד לאחר התלייה.
לה עומדת זכות הראשונים להכניס לראשי את התובנה לפיה מי שמשתין על כללי המשחק בחייו – שלא ייאחז בהם במותו, מי שמנצל לרעה את כוחו, משכיב את החלשים אל הקרשים וממשיך לבעוט בהם גם אז, שלא יבוא בטענות על מי שעושה לו את אותו הדבר כאשר הוא כבר מתחת לקרשים, ומי שלא מכין את הגנתו עוד בחייו – אין לו להלין אלא על עצמו.
ולא בטוח שאלה כל המקרים.
מדוע לא אצטרף לפסטיבל הנאור הזה?
